TERMS AND CONDITIONS

Please carefully review these Terms and Conditions before using this website, registering an account, or placing a bid.

You are entering into this agreement with A.H.G., Inc. d/b/a Federal Asset Recovery Services, hereinafter referred to as “FARS,” owner and operator of SeizedPropertyAuctions.com.

By registering for this website, placing a bid, submitting an offer to purchase, or otherwise using the website, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions, together with any additional terms, policies, disclosures, or conditions applicable to a particular auction, event, or item.

You may browse portions of the website without registering; however, to view current bids, complete Part 1 of registration with your name and email address. To bid, access your account and edit your profile to include your phone number, billing address, and shipping address. Full registration is required to participate in auction events and obtain full access to certain website features. Site registration is free of charge.

REGISTRATION AND ACCOUNT RESPONSIBILITY

To register for this website, you must be at least 18 years of age and legally eligible to enter into and form binding contracts under applicable law.

You must provide your full legal name, telephone number, email address, billing address, shipping address, and any other information requested by FARS. You agree that all information provided will be truthful, accurate, complete, and current and that you will update such information when necessary.

FARS reserves the right to verify a user’s identity, address, payment information, or other account information by email, telephone, payment verification, identification documents, or other reasonable means.

Accounts containing false, misleading, incomplete, or unverifiable information may be suspended or terminated.

Upon registration, you will create a username or user ID and password. Your username may be visible to other users when you place bids on the website.

It is your responsibility to protect your password and account credentials and not disclose them to unauthorized persons. You are responsible for all activity conducted through your account.

If you believe the security of your account has been compromised, you should immediately change your password and contact FARS.

FARS reserves the right, in its sole discretion and without liability, to refuse service, restrict account privileges, suspend bidding privileges, or terminate an account when reasonably necessary to protect FARS, its customers, its consignors, or the integrity of its auctions.

REQUIRED ELECTRONIC COMMUNICATIONS

By creating an account, you consent to receive electronic communications relating to your account and participation in Seized Property Auctions.

Such communications may include account verification, registration confirmations, bidding activity, winning-bid notices, invoices, payment reminders, deposit requests, account-status notices, shipping information, return-related communications, and other transactional or administrative notices.

To the extent permitted by applicable law, electronic communications satisfy any requirement that such communications be provided in writing.

It is the bidder’s responsibility to monitor their account and determine whether they have won an item.

Failure to receive or review an email, text message, automated notification, invoice, or other electronic communication does not relieve a winning bidder of the obligation to pay for an item won at auction.

LAWFUL USE, FRAUD, AND ACCOUNT MISUSE

This website and its services may only be used for lawful purposes and in a lawful manner.

Users agree to comply with all applicable laws, statutes, regulations, and these Terms and Conditions regarding use of the website, bidding, payment, and the purchase of merchandise.

Users may not engage in fraudulent, deceptive, abusive, or manipulative conduct, including but not limited to:

  • Registering under a false or fictitious identity;
  • Providing false, misleading, or incomplete account information;
  • Impersonating another person;
  • Using stolen, unauthorized, invalid, or fraudulent payment information;
  • Creating or using multiple accounts to circumvent account restrictions or obtain an unfair bidding advantage;
  • Placing bids without the intent or ability to complete payment;
  • Engaging in bid manipulation, collusion, fictitious bidding, or other conduct intended to interfere with the integrity of an auction;
  • Interfering or attempting to interfere with the operation, security, or functionality of this website;
  • Filing fraudulent, abusive, or bad-faith payment disputes or chargebacks; or
  • Engaging in any other conduct that FARS reasonably determines to be fraudulent, abusive, or harmful to its customers, consignors, payment processors, or business operations.

Fraudulent conduct may constitute a violation of federal or state law.

FARS may report suspected fraudulent activity to payment processors, financial institutions, collection agencies, credit reporting agencies where legally permitted, or law enforcement and may cooperate with any resulting investigation.

Without limiting any other remedy, FARS may suspend or terminate an account, reject or cancel bids, require additional identity or payment verification, require a security deposit, withhold shipments, pursue collection efforts, or take other reasonable action to protect the integrity of its auctions.

BIDDING AND BINDING OFFERS

A bid or offer to purchase is a legally binding offer.

Once submitted, a bid may not be withdrawn or canceled except where required by law or expressly authorized by FARS.

By placing a bid, you acknowledge that you have reviewed the item description, photographs, buyer’s premium, shipping costs, applicable fees, auction terms, and these Terms and Conditions and that you have had an opportunity to ask questions before bidding.

If a measurement, specification, condition issue, reference number, provenance detail, authentication issue, photograph, or other characteristic is important to your purchasing decision, you are responsible for requesting clarification before placing a bid.

FARS shall have complete discretion, without liability, to reject or refuse any online bid or terminate bidding privileges for any bidder when reasonably necessary, including before, during, or after an auction.

If a dispute arises between two or more bidders, FARS shall be the final arbiter of the bidding dispute, and FARS’s designation of the successful bidder shall be final to the extent permitted by applicable law.

At FARS’s sole discretion, a winning bid or transaction may occasionally be canceled as a one-time accommodation, subject to an agreed restocking or cancellation fee. Payment of any such fee does not create a general right to cancel future bids or transactions.

FARS may establish reserve prices, minimum bids, bidding increments, bidder qualifications, or other bidding requirements. Reserve prices may remain confidential.

FARS reserves the right to bid on its own behalf or for the benefit of a consignor up to an applicable reserve amount.

If the applicable minimum bid or reserve price is not met, the seller is not obligated to sell the item.

GOOD-FAITH DEPOSITS AND BIDDER VERIFICATION

At the sole discretion of FARS, bidders may be required to provide a good-faith or security deposit before placing or continuing to place bids.

Deposit requirements may be based on bidding activity, dollar thresholds, account history, payment history, verification requirements, or other reasonable risk factors.

FARS may also require additional identity, address, payment, or financial verification before accepting bids, processing payment, or releasing merchandise.

If a bidder does not win any items, the applicable deposit will be refunded in accordance with the terms disclosed when the deposit was requested.

If the bidder wins one or more items, the deposit may be applied toward the total amount due on the bidder’s invoice.

A bidder who fails to pay for auction items when payment is due shall forfeit any applicable deposit to the extent permitted by law.

AUCTION CLOSING TIMES, TECHNICAL ISSUES, AND AUCTIONEER DISCRETION

Auctions are generally scheduled to close at the published date and time.

FARS reserves the right to extend, postpone, suspend, reopen, or otherwise modify an auction or individual lot when reasonably necessary because of bidding activity, technical problems, suspected fraud, website interruptions, or other circumstances affecting the integrity of the auction.

FARS shall not be responsible for bids that are not transmitted, received, or recorded because of internet delays, telecommunications failures, equipment failures, software malfunctions, user error, or other technical conditions.

Bidders are encouraged not to wait until the final seconds of an auction to place a bid as deposit requirements or other account verification procedures may delay bid acceptance.

FARS may withdraw an auction, event, lot, or item at any time when reasonably necessary and may cancel or void affected bids or transactions.

FARS may also alter the website, add or remove features, auctions, events, merchandise, or services, or suspend or terminate services when reasonably necessary.

THIRD-PARTY CONSIGNORS AND SALE CONFIRMATION

Items offered for sale may be owned or consigned by federal, state, or local agencies, financial institutions, estates, businesses, private consignors, or other third parties, and in some cases may be owned by FARS.

Certain items may be subject to additional requirements, restrictions, approvals, or confirmation by the consignor.

A winning-bid notification shall not constitute final confirmation where consignor approval or other confirmation is required.

If required confirmation cannot be obtained, FARS may void the transaction and refund any amounts paid by the purchaser.

Except where otherwise required by law, such refund shall constitute the purchaser’s sole remedy arising from the inability to obtain confirmation.

MERCHANDISE, DESCRIPTIONS, AND BIDDER DUE DILIGENCE

Except for specific guarantees expressly stated in these Terms and Conditions or in an individual auction listing, merchandise is sold on an “AS IS” basis.

Descriptions appearing on the website and in auction materials are prepared in good faith and are believed to be accurate at the time of listing.

Unless expressly stated as guaranteed, exact dates, dimensions, weights, measurements, condition, quality, grade, estimated value, market value, country of origin, and similar characteristics are not guaranteed.

Photographs may be enlarged, cropped, enhanced, or otherwise presented to assist bidders in viewing merchandise and details.

Photographs and images displayed on the website may include photographs of the actual item, stock or representative images, digitally enhanced images, and images that are AI-generated or AI-assisted. Images that are not photographs of the actual item are provided for illustrative or representative purposes and should not be relied upon as an exact representation of the merchandise being offered.

Representative, supplemental, stock, or AI-generated images should not be relied upon to establish the exact condition, dimensions, color, configuration, accessories, packaging, or other physical characteristics of an item. Bidders should rely on photographs identified as depicting the actual item together with the written listing and any express guarantees.

FARS may use artificial intelligence (“AI”), image-processing technologies, automated systems, and other technology-assisted tools to assist in preparing, reviewing, enhancing, organizing, categorizing, translating, or presenting item descriptions, titles, photographs, images, categorizations, and other website or auction content.

AI and similar technologies may also be used to enhance photographs of actual merchandise or to create supplemental, representative, or illustrative images relating to an auction item.

FARS may review AI-generated or AI-assisted content for accuracy; however, FARS does not represent or warrant that every AI-generated, AI-assisted, enhanced, translated, categorized, or automated element has been individually reviewed by a human before publication.

AI-generated, AI-assisted, enhanced, translated, categorized, or automated content may contain errors, omissions, inaccuracies, or other unintended results.

All merchandise is sold subject to the complete item listing, photographs, applicable disclosures, and these Terms and Conditions. Bidders remain solely responsible for conducting their own due diligence and reviewing all available information before placing a bid.

If any information generated, enhanced, translated, categorized, or presented with the assistance of AI or another automated technology is important to a bidder’s purchasing decision, the bidder should contact FARS and request clarification before bidding.

FARS reserves the right to correct, modify, supplement, replace, or update AI-generated, AI-assisted, digitally enhanced, translated, categorized, or other automated content at any time, with or without prior notice, subject to applicable law.

Minor imperfections, ordinary wear, minor variations in measurements, or differences of opinion regarding condition, quality, grade, or value shall not constitute grounds for voiding a sale unless the item is materially different from an express guarantee contained in the auction description.

Outside appraisals, certificates, retail price tags, grading opinions, estimated values, and similar documentation may reflect the opinion of a third party and are provided for informational purposes only.

They do not constitute a guarantee by FARS of current market value, resale value, grade, or other subjective characteristics unless expressly stated otherwise.

Market values fluctuate, and FARS does not guarantee that merchandise can be resold for any particular amount.

Bidders are solely responsible for reviewing the complete written description, photographs, disclosed fees, shipping charges, and all other available information before bidding.

If additional information is important to a bidder’s purchasing decision, the bidder should request that information before placing a bid.

Certain items offered for sale, including swords, knives, edged weapons, collectibles, or other regulated merchandise, may be subject to federal, state, local, or other legal restrictions concerning purchase, possession, shipment, transfer, or use. It is the bidder’s sole responsibility to determine whether an item is lawful to purchase, receive, possess, or use in the bidder’s jurisdiction before placing a bid. Do not bid on any item that is prohibited or restricted in your area. FARS does not warrant that any item may be lawfully purchased, shipped to, possessed, or used by every bidder in every jurisdiction.

FARS reserves the right to refuse or cancel a transaction or shipment if FARS determines that completing the transaction or shipment may violate applicable law, regulation, or carrier restriction.

JEWELRY, GOLD, SILVER, WATCHES, AND GEMSTONES

Jewelry, gold, silver, watches, and gemstones are guaranteed to be genuine as described.

Gold items are guaranteed to be the karat quality stated in the auction description.

Exact weights, sizes, measurements, quality, grade, condition, and value are not guaranteed unless specifically stated otherwise.

Watches are guaranteed as to make and model as described but may contain aftermarket or replacement parts unless specifically represented as containing 100% manufacturer-original components.

Brand-name items may contain replacement, aftermarket, or other non-original components unless expressly represented otherwise.

Although a watch may be running when examined or listed, continued operation, timekeeping accuracy, water resistance, and future mechanical performance are not guaranteed unless specifically stated in the listing.

Outside appraisals and third-party documentation are provided for informational purposes and are not guarantees by FARS of grade or value.

Purchasers are strongly encouraged to complete any desired independent examination or authentication during the applicable 21-day in-hand examination period before mounting, setting, altering, modifying, repairing, or incorporating an item into other property.

ARTWORK, LITHOGRAPHS, PRINTS, AND OTHER ART ITEMS

Artwork is guaranteed as to the artist, signature, and medium as represented in the auction description.

Exact measurements, condition, and value are not guaranteed unless specifically stated as guaranteed in the listing.

The condition of frames, glass, matting, mounting, and other presentation materials is not guaranteed and shall not constitute grounds for voiding a sale unless specifically included in an item-specific guarantee.

Certificates of authenticity are provided for informational purposes and may reflect the professional opinion of the issuer.

Any dispute concerning the certificate itself is between the issuer and purchaser unless the underlying artwork fails to conform materially to an express guarantee made by FARS.

Any question concerning authenticity must be raised within the applicable 21-day in-hand guarantee period.

NUMISMATIC ITEMS

Numismatic items are guaranteed to be authentic as to date, mint mark, and genuineness.

Grades and certifications issued by outside grading services involve professional judgment and are subject to differing interpretations. Grades and values are therefore not guaranteed by FARS.

FARS is not a coin grading authority and does not guarantee any opinion regarding grade or value.

No numismatic item may be returned because of a difference of opinion concerning grade, condition, market value, or resale value.

Unless specifically stated otherwise, FARS does not guarantee that a coin has never been cleaned.

Bulk lots and rolls of coins are final sale and may not be returned for any reason other than a misstated date, misstated mint mark, or a determination that a numismatic item is counterfeit or otherwise not genuine.

Items removed from their original heat-sealed or sealed FARS holder or flip may not be returned.

Except for a misstated date, misstated mint mark, or a determination that the item is counterfeit or otherwise not genuine, all numismatic sales are final.

RETURNS AND 21-DAY IN-HAND GUARANTEE

Except as expressly provided in these Terms and Conditions, all auction sales are final.

FARS stands behind the authenticity and material accuracy of the express guarantees contained in its auction descriptions.

A purchaser who makes payment within the required payment period has 21 days with the item in hand, beginning on the documented date of delivery, to examine the item and notify FARS of a claim that the item is not genuine or is materially different from an express guarantee contained in the auction description.

If a purchaser submits a timely claim within the applicable 21-day in-hand period and FARS determines that the item is not genuine as represented or is materially different from an express guarantee contained in the auction description, FARS will accept the return and refund the full amount actually paid to FARS for the affected item, subject to the return procedures contained in these Terms.

Returns are not accepted merely because a purchaser changes their mind, dislikes the item, disagrees with an appraisal or estimated value, believes they paid too much, finds a similar item available elsewhere for a different price, disagrees with a subjective grade or condition assessment, or expected a characteristic that was not represented or guaranteed in the auction description.

All returns require prior written authorization from FARS.

At the discretion of FARS, a purchaser making an authenticity or material-description claim may be required to provide a written opinion from an unbiased and reputable third-party expert stating how the item is not genuine or is materially different from the auction description.

Such documentation must be on professional letterhead and include the expert’s name, business name, address, telephone number, and other information reasonably necessary for FARS to verify the opinion.

FARS is not responsible for appraisal, inspection, authentication, laboratory testing, grading, expert, professional, or consultation fees incurred by the purchaser in obtaining such documentation unless otherwise agreed in writing or required by applicable law.

Unauthorized returns are made at the sender’s sole risk and may be refused.

Except in the case of a valid and timely authenticity claim, merchandise must be returned in substantially the same condition in which it was received.

Alteration, damage, removal from sealed packaging where applicable, modification, mounting, setting, repair, cleaning, or other material changes may eliminate return eligibility for claims unrelated to authenticity.

Nothing in the preceding paragraph shall prevent a purchaser from making a valid authenticity claim during the 21-day in-hand period solely because an item has been mounted, set, altered, or incorporated into another item, provided the original auction item can be reasonably identified and examined to determine authenticity.

Failure to make payment within the required payment period eliminates all return privileges, except to the extent a remedy is required by applicable law.

No item is returnable after the applicable 21-day period unless expressly authorized in writing by FARS or required by law.

LIMITATION OF REMEDY FOR AUTHENTICITY OR DESCRIPTION CLAIMS

If FARS determines that a timely claim concerning authenticity or a material discrepancy from an express auction description is valid, the purchaser shall be entitled to a full refund of all amounts actually paid to FARS for the affected auction item.

For purposes of this provision, amounts actually paid to FARS include the winning bid, buyer’s premium, shipping and handling charges, and applicable taxes attributable to the affected item and actually collected by FARS, subject to applicable tax and refund laws.

The refund does not include amounts paid directly to third parties or governmental authorities and not collected by FARS, including, without limitation, international or cross-border transaction fees, customs duties, tariffs, brokerage fees, import or export charges, foreign taxes, currency-conversion fees, carrier-imposed charges, or other third-party fees or assessments.

Except where applicable law requires otherwise, FARS shall have no obligation to reimburse the purchaser for any amount that was not actually paid to and retained by FARS in connection with the affected auction item.

Except where applicable law requires otherwise, the purchaser’s recovery shall not exceed the total amount actually paid to FARS for the affected item.

To the maximum extent permitted by applicable law, FARS shall not be responsible for incidental, consequential, special, indirect, exemplary, or similar costs, losses, or damages incurred by the purchaser in connection with the affected item, including but not limited to:

  • Costs of mounting, setting, framing, altering, modifying, resizing, repairing, restoring, cleaning, or incorporating the item into another object;
  • The cost or value of custom jewelry, mountings, settings, frames, displays, or other property purchased, manufactured, modified, or created for use with the auction item;
  • Appraisal, authentication, laboratory testing, grading, inspection, expert, professional, or consultation fees;
  • Jeweler, craftsman, designer, manufacturing, or other labor charges;
  • Travel expenses, shipping expenses paid to third parties, lost time, inconvenience, or loss of use;
  • Lost income, lost profits, lost opportunities, or loss of business; or
  • Any claimed increase or decrease in value of other property into which the auction item has been mounted, set, incorporated, or otherwise associated.

Purchasers assume the risk of incurring expenses associated with mounting, setting, altering, modifying, repairing, framing, incorporating, or otherwise materially changing an auction item before completing any desired independent examination during the applicable 21-day in-hand period.

The fact that a purchaser incurs additional expenses involving an auction item does not increase FARS’s financial obligation beyond the remedies expressly provided in these Terms and Conditions.

The return and refund remedy described in this section is intended to provide the purchaser with a full refund of the affected auction transaction while limiting FARS’s responsibility for subsequent expenditures or consequential losses incurred by the purchaser.

PAYMENT, BUYER’S PREMIUM, FEES, AND DEFAULT

Your bid or offer to purchase constitutes your agreement to pay for the item if your bid is accepted.

Unless different payment terms are expressly stated for a particular auction, item, or approved payment plan, full payment is due within 48 hours following acceptance of the winning bid.

The winning bidder is responsible for the entire invoiced amount, including:

  • Winning bid amount;
  • Buyer’s premium;
  • Shipping and handling charges;
  • Applicable taxes; and
  • Any other charges properly disclosed before bidding.

The buyer’s premium and applicable fees are part of the auction transaction and should be considered before placing a bid.

Payment must be made by the registered bidder using a payment method owned by, issued to, or otherwise authorized for use by that bidder.

FARS reserves the right to reject, delay, or hold any payment that appears to originate from an unrelated third party or that cannot be reasonably verified.

FARS may, in its sole discretion, approve an alternative payment arrangement after completing any identity, payment, or fraud-prevention verification it considers appropriate.

Failure to pay an invoice when due constitutes a breach of the bidder’s agreement and eliminates all return privileges, except to the extent otherwise required by applicable law.

Upon default, and to the extent permitted by law, FARS may:

  • Suspend or terminate bidding privileges;
  • Cancel an installment or payment arrangement;
  • Retain or forfeit applicable deposits;
  • Offer the item to another bidder;
  • Hold the defaulting bidder responsible for any deficiency resulting from a subsequent sale;
  • Cancel the unpaid transaction;
  • Re-auction or otherwise dispose of the merchandise;
  • Withhold other merchandise awaiting shipment;
  • Refer the outstanding balance for collection; or
  • Pursue any other remedy available under these Terms or applicable law.

Where a bidder has separately authorized FARS to maintain or charge a payment method on file, FARS may charge that authorized payment method for amounts properly due in connection with the bidder’s transaction, to the extent permitted by applicable law and the applicable payment authorization.

FARS may request additional identity or payment verification before processing payment or releasing merchandise.

FARS shall be entitled to recover reasonable collection costs and attorney’s fees resulting from a bidder’s breach to the extent permitted by applicable law.

FARS does not impose interest, late-payment fees, or returned-payment fees unless separately disclosed and agreed to in writing.

TAXES, DUTIES, AND OTHER GOVERNMENTAL CHARGES

The purchaser is responsible for all applicable sales taxes, use taxes, customs duties, import or export charges, brokerage fees, regulatory assessments, and other governmental charges arising from the purchase, shipment, delivery, ownership, or use of merchandise, except to the extent FARS is required by applicable law to collect and remit such amounts directly.

Any such charges imposed by a governmental authority, customs agency, carrier, broker, or other third party are the purchaser’s responsibility and are not included in the auction price unless expressly stated otherwise.

SHIPPING, DELIVERY, TITLE, RISK OF LOSS, RETURNED SHIPMENTS, AND UNCLAIMED PROPERTY

Merchandise will generally be shipped after full payment has been received and cleared.

Purchasers are responsible for maintaining a correct and deliverable shipping address.

FARS may require merchandise to be shipped to a verified billing address or other approved shipping address and may request additional identity or payment verification before shipment.

Shipping and handling charges may include postage or carrier charges, insurance, materials, handling, labor, processing, and related fulfillment expenses.

Shipping and delivery dates are estimates and are not guaranteed.

Title to purchased merchandise and risk of loss shall pass to the purchaser upon FARS’s tender of the merchandise to the applicable shipping carrier following receipt of full cleared payment.

Once merchandise has been accepted by the carrier for shipment, FARS shall not be responsible for loss, theft, damage, delay, misdelivery, or other events occurring in transit, except to the extent FARS has expressly agreed in writing to provide a different remedy or applicable law requires otherwise.

FARS may, as a customer-service accommodation and without assuming additional liability, assist purchasers with carrier claims or insurance claims relating to shipment loss or damage.

If merchandise is returned, refused, undeliverable, or unclaimed because of an incorrect address or action or inaction by the purchaser, the purchaser shall be responsible for any additional shipping, handling, storage, or reshipping expenses.

FARS is not a storage facility and cannot indefinitely hold purchased merchandise.

If merchandise is returned, refused, undeliverable, or otherwise remains unclaimed, the purchaser must make satisfactory arrangements for delivery, reshipment, or pickup within thirty (30) days after notice from FARS.

If satisfactory arrangements are not made within thirty (30) days after notice, FARS may, to the extent permitted by applicable law, treat the merchandise as abandoned and may resell, re-auction, dispose of, or otherwise handle the property without refund to the purchaser.

Any abandoned-property procedure remains subject to applicable law.

WEBSITE AND LISTING ERRORS

FARS makes reasonable efforts to provide accurate information; however, typographical, clerical, pricing, photograph, description, inventory, technical, or other errors may occasionally occur.

Such errors may include errors, omissions, inaccuracies, or unintended results contained in AI-generated, AI-assisted, digitally enhanced, translated, categorized, or other automated website content.

FARS reserves the right to correct, modify, or update an error or omission when discovered, including after bidding has begun or an auction has closed.

FARS also reserves the right to correct, modify, supplement, replace, or update AI-generated, AI-assisted, digitally enhanced, translated, categorized, or automated content when an error, omission, or inaccuracy is discovered.

If an error materially affects an item, auction, bid, or transaction, FARS may, in its reasonable discretion:

  • Correct the listing;
  • Notify affected bidders;
  • Reject or cancel affected bids;
  • Reopen or extend bidding;
  • Withdraw the item;
  • Void the sale;
  • Cancel the transaction; or
  • Refund amounts paid.

If FARS voids a transaction because of a material listing or technical error and refunds all amounts paid, such refund shall constitute the purchaser’s sole remedy to the extent permitted by applicable law.

EVENTS BEYOND FARS’S REASONABLE CONTROL

FARS shall not be liable for any delay, interruption, suspension, or failure to perform resulting from circumstances beyond its reasonable control.

Such circumstances may include severe weather, natural disasters, fire, flood, power outages, internet or telecommunications failures, computer or software failures, cybersecurity incidents, unauthorized access, payment processor or banking interruptions, shipping carrier delays, transportation disruptions, government actions, legal restrictions, labor disputes, public emergencies, or other comparable events beyond FARS’s reasonable control.

Under such circumstances, FARS may delay shipments, extend auction closing times, postpone or suspend auctions, cancel affected transactions, suspend services, or take other reasonable action necessary to preserve the integrity of its auction operations.

WEBSITE DISCLAIMER AND DISCLAIMER OF WARRANTIES

This website is provided on an “AS IS” and “AS AVAILABLE” basis.

FARS does not guarantee uninterrupted or error-free access to the website.

FARS shall not be responsible for website interruptions, inaccurate transmission of bids, software failures, hardware failures, telecommunications problems, errors, omissions, or similar irregularities except to the extent liability cannot lawfully be excluded.

FARS does not warrant that AI-generated, AI-assisted, automated, translated, categorized, digitally enhanced, or technology-assisted content will be free from errors, omissions, or inaccuracies. Such content remains subject to the specific guarantees expressly provided elsewhere in these Terms and Conditions or in an individual item listing.

Except for the specific merchandise guarantees expressly stated in these Terms and Conditions or in an individual auction listing, FARS disclaims all warranties of any type, express or implied, to the maximum extent permitted by law, including implied warranties of MERCHANTABILITY and FITNESS FOR A PARTICULAR PURPOSE.

Nothing in this section eliminates or limits an express authenticity or description guarantee specifically provided elsewhere in these Terms and Conditions.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, FARS and its owners, officers, employees, agents, affiliates, consignors, contractors, and service providers shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to use of the website, participation in an auction, a transaction, or merchandise purchased through the website.

This includes, without limitation, lost profits, lost income, lost business opportunities, loss of data, loss of use, or similar consequential losses.

To the maximum extent permitted by applicable law, the total aggregate liability of FARS arising from any particular item, auction, transaction, or use of the website shall not exceed the amount actually paid to FARS by the purchaser in connection with the matter giving rise to the claim.

Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited.

INDEMNIFICATION

To the maximum extent permitted by applicable law, each user agrees to indemnify, defend, and hold harmless A.H.G., Inc. d/b/a Federal Asset Recovery Services (“FARS”), its owners, officers, employees, agents, affiliates, consignors, contractors, and service providers from and against claims, demands, actions, liabilities, losses, damages, judgments, costs, and reasonable attorney’s fees arising out of or relating to:

  • The user’s breach of these Terms and Conditions;
  • The user’s violation of applicable law or regulation;
  • False, misleading, inaccurate, incomplete, or fraudulent information provided by the user;
  • Unauthorized, fraudulent, or improper use of the user’s account or payment method;
  • Fraudulent, abusive, or bad-faith chargebacks or payment disputes initiated by or on behalf of the user;
  • The user’s misuse of this website or interference with an auction, transaction, payment, or shipment;
  • Fraudulent bidding, bid manipulation, collusion, account misuse, or other prohibited conduct by the user; or
  • A third-party claim arising from the user’s acts or omissions in connection with use of the website, participation in an auction, purchase of merchandise, or subsequent disposition or use of merchandise.

This indemnification obligation does not require a user to indemnify FARS for losses to the extent caused by FARS’s gross negligence, willful misconduct, or other conduct for which liability cannot lawfully be excluded or shifted.

FARS reserves the right to assume control of the defense of any matter subject to indemnification, and the user agrees to reasonably cooperate in the defense of such matter.

INTELLECTUAL PROPERTY

FARS is the owner or authorized licensee of intellectual property rights associated with SeizedPropertyAuctions.com, including website content, software, text, photographs, graphics, auction materials, trademarks, and other proprietary materials.

These rights are protected by applicable state and federal law.

No person may reproduce, republish, distribute, transmit, scrape, commercially exploit, or otherwise use proprietary FARS content without prior written authorization, except as otherwise permitted by applicable law.

Item listings may reference or display third-party trademarks, trade names, artist names, copyrighted works, logos, brands, or other intellectual property solely for purposes of identifying, describing, or offering merchandise for resale. Such use does not imply sponsorship, affiliation, authorization, or endorsement by the applicable artist, manufacturer, distributor, rights holder, or other third party.

FARS may receive claims or objections from third parties concerning intellectual property or alleged rights in merchandise or auction content. FARS reserves the right to review any such claim, request supporting documentation, modify or remove a listing, suspend or cancel a transaction, or take any other action FARS reasonably determines appropriate. FARS shall not be required to remove or cancel a listing solely because a third party asserts a claim, except where required by applicable law or legal process.

PRIVACY

FARS respects the privacy of its users.

Information collected through the website may be used to administer accounts, verify identity, process transactions, provide customer support, prevent fraud, fulfill orders, communicate with bidders, and comply with applicable legal obligations.

FARS does not sell or rent personal information except as disclosed in its Privacy Policy.

Information may be shared with payment processors, shipping carriers, fraud-prevention providers, service providers, collection providers, governmental authorities, or other parties when reasonably necessary to operate the business or comply with law.

Please review the FARS Privacy Policy for additional information concerning the collection and use of personal information.

REVISIONS TO THESE TERMS

FARS reserves the right to modify, amend, or update these Terms and Conditions at any time.

Unless otherwise stated, revised Terms and Conditions become effective when posted on the website.

Continued use of the website, registration, participation in an auction, or placement of a bid after revised Terms have been posted constitutes acceptance of those revisions.

FARS is not obligated to provide individual notice of revisions unless required by applicable law.

It is the responsibility of each bidder to review the Terms and Conditions in effect before placing a bid.

ENTIRE AGREEMENT, SEVERABILITY, AND WAIVER

These Terms and Conditions, together with the Privacy Policy, applicable auction-specific terms, item-specific disclosures, and other policies expressly incorporated by reference, constitute the entire agreement between the user and FARS concerning use of the website and participation in Seized Property Auctions.

These Terms supersede prior oral or written understandings concerning the same subject matter.

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

FARS’s failure to enforce any provision of these Terms on one occasion shall not constitute a waiver of its right to enforce that provision on another occasion.

NO THIRD-PARTY BENEFICIARIES

These Terms and Conditions are intended solely for the benefit of FARS and the registered user, except where these Terms expressly provide otherwise.

Nothing in these Terms is intended to create any contractual right, claim, or remedy in favor of any other person or entity.

ASSIGNMENT

FARS may assign, transfer, delegate, or otherwise convey any of its rights or obligations under these Terms and Conditions, in whole or in part, to an affiliate, successor, purchaser of substantially all of its assets or business, or other entity associated with a merger, acquisition, reorganization, or transfer of business operations.

A registered user may not assign, transfer, delegate, or otherwise convey any rights or obligations arising under these Terms and Conditions or any auction transaction without the prior written consent of FARS.

Any attempted assignment by a user without such consent shall be void to the extent permitted by applicable law.
